1 . Once ducks are launched, they are on their own, except that the race committee reserves the right to free them if caught in branches or other river impediments. 2. All ducks entered will be provided by the CAPC (Child Abuse Prevention Council of San Joaquin) and shall remain their property after the race. 3. Once the ducks are launched, they are on their own. Attempts to assist ducks caught in obstacles will be made by race volunteers only. 4. Winners will be determined by serial number on adoption log corresponding to the number of each duck in order of finish. If an unadopted duck should finish in the top winning number of ducks, that number shall be disallowed in favor of the next adopted duck to finish. 5. Winners will be announced at the end of the race. They will also be notified by telephone if not present. Winners will be instructed on method of claiming their prize. It is not necessary for “adopters” of winning ducks to be present to claim prize(s). 6. Decision of the judges stationed at the finish line will be final. Judges are not eligible to win. 7. No cash equivalent prizes or exchanges will be provided in lieu of the designated prizes. Any taxes and fees are the responsibility of the winner. 8. By entering, the entrants release the Presenter, the beneficiary, its officers, directors, volunteers, staff, and other related entities from any and all liability with respect to prizes, the race, the CAPC, and City of Stockton. 9. By entering, winners consent to the promotional use of their names and likenesses without additional compensation. 10. No purchase is necessary to enter. CAPC does request, however, a minimum donation of $5.00 per adoption to benefit the children & families of the CAPC. CAPC is a non-profit charitable organization under Sec. 501(c)(3) of the Internal Revenue Code (Federal Tax ID No. 94-20497046). Entries are not considered tax deductible by the IRS. 11. A free duck adoption may be obtained by presenting, in person, a handwritten request for a free adoption along with a self-addressed, stamped envelope and a completed adoption paper between the hours of 9 a.m. and 4 p.m., Monday through Friday (except holidays) at the CAPC. Limit: one free adoption per person. Each person requesting a free adoption must apply at the CAPC in person. CAPC regrets that requests for free adoptions received after 12 p.m., May 5, 2018, or after all available ducks have been adopted, cannot be honored. 12. Employees of the CAPC are not eligible to win. 13. Entrants must be at least 18 years of age to file adoption papers. 14. The race will proceed as scheduled, rain or shine. 15. Refunds will not be granted for any reason. 16. Prizes not claimed by July 13, 2018 will be forfeited.
